1. Acceptance of Terms
By accessing or using Phantom ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Phantom is an AI-powered lead generation and outreach automation platform. The Service includes lead discovery, AI-based lead scoring, automated email outreach, content calendar generation, and related features depending on your subscription tier.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements.
4. Account Registration
You must provide accurate, complete information when subscribing. You are responsible for maintaining the confidentiality of your account and for all activities under your account. You must notify us immediately of any unauthorized use.
5. Subscription Plans & Billing
- Subscriptions are billed monthly via Stripe.
- Each plan includes a defined number of monthly lead discoveries and features as described on the pricing page.
- Unused discoveries do not roll over to the next billing period.
- You may upgrade, downgrade, or cancel your plan at any time through the billing page in your dashboard.
- Cancellations take effect at the end of the current billing period. No prorated refunds are issued.
6. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Send spam, deceptive, or misleading communications through the Service
- Violate the CAN-SPAM Act, GDPR, or any applicable email/communication laws
- Use discovered data to harass, stalk, or harm any individual or business
- Attempt to reverse-engineer, copy, or redistribute the Service
- Share your account credentials with third parties
- Use the Service in any way that could damage, disable, or impair the platform
7. Data & Lead Information
Phantom discovers publicly available business information from sources including Google Places and public websites. We do not guarantee the accuracy, completeness, or timeliness of any discovered data. You are solely responsible for how you use the data obtained through the Service.
8. AI-Generated Content
Phantom uses artificial intelligence to generate outreach emails, DMs, content calendars, and other communications. All AI-generated content is presented for your review and approval before sending. You are responsible for reviewing and approving all content before it is sent to any recipient.
9. Intellectual Property
The Service, including all software, design, and content, is owned by Phantom and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
10. Marketplace
Phantom includes a two-sided marketplace where users can buy and sell professional services (video editing, design, copywriting, etc.). By using the Marketplace, you agree to the following:
10.1 Escrow Payments
- All marketplace transactions are processed through Phantom's escrow system via Stripe.
- Buyer payments are held by Phantom until the buyer approves the delivery or the 72-hour auto-release window expires.
- Phantom is not a party to the transaction between buyer and seller - we facilitate the payment and dispute resolution process.
10.2 Fees
- Buyer fees: A marketplace fee of 3.4% (card) or 2.5% (ACH) plus payment processing fees is added to the service price at checkout.
- Seller fees: Phantom subscribers (Scout, Hunter, Operator) pay 0% seller fee. Marketplace-only sellers pay a 7% seller fee on completed transactions.
- Fees are non-negotiable and may be updated with 30 days' notice to active users.
10.3 Delivery & Auto-Release
- Once a seller marks an order as delivered, the buyer has 72 hours to review and either approve, request a revision, or file a dispute.
- If the buyer does not respond within 72 hours, funds are automatically released to the seller.
- A warning email is sent to the buyer 24 hours before auto-release.
10.4 Refund Policy
- Before seller acceptance: Buyers may cancel and receive a full refund at any time before the seller accepts the order.
- Seller declines: If a seller declines an order, the buyer receives a full automatic refund.
- Disputes: If a dispute is filed and resolved in the buyer's favor, a full or partial refund will be issued at Phantom's discretion.
- After auto-release: Once funds have been released to the seller (either by buyer approval or 72-hour auto-release), refunds are not available through Phantom. Buyers should file a dispute before the auto-release window closes.
- Refunds are processed to the original payment method and typically arrive within 3-5 business days.
10.5 Disputes
- Disputes must be filed within 48 hours of delivery through Phantom's resolution center.
- Phantom's resolution team reviews all chat history, deliverables, and order details before making a decision.
- Dispute outcomes may include: full refund to buyer, full release to seller, or a split between both parties.
- Phantom's dispute resolution decisions are final.
- Filing fraudulent disputes or chargebacks outside of Phantom's process may result in account suspension.
10.6 Seller Responsibilities
- Sellers must deliver original work that matches their listing description.
- Sellers must complete work within the agreed delivery timeframe.
- Sellers must not solicit buyers to transact outside of Phantom.
- Misleading samples, plagiarized work, or failure to deliver may result in listing removal and account suspension.
10.7 Buyer Responsibilities
- Buyers must provide clear requirements and necessary assets within 24 hours of order placement.
- Buyers must review deliveries within the 72-hour window.
- Buyers must not contact sellers outside of Phantom to bypass marketplace fees.
10.8 Payouts
- All marketplace and affiliate payouts are processed exclusively through Stripe Connect. No other payout methods (PayPal, bank transfer, wire, crypto) are supported.
- Sellers and affiliates must complete Stripe Connect onboarding and link a valid bank account before requesting payouts.
- Minimum payout threshold for affiliates is $50. Marketplace sellers may request payouts at any balance.
- Payouts over $500 require manual admin approval.
- Phantom reserves the right to hold payouts if fraud or policy violations are suspected.
11. Phantom Guarantee
New subscribers are eligible for the Phantom Guarantee: if you do not see a return on investment within your first 30 days, your second month is free. To qualify, you must complete the following within your first 30 days of membership:
- At least 250 lead searches using the Lead Finder
- At least 50 email outreaches sent through the platform
- At least one marketplace transaction attempt (buying or selling a service)
The Phantom Guarantee applies once per account and cannot be combined with other promotions or discounts. Phantom reserves the right to verify usage data before applying the credit. The free month credit is applied to the next billing cycle and is non-transferable.
12. Limitation of Liability
To the maximum extent permitted by law, Phantom and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
13. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
14. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion, with or without notice.
15. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify active subscribers of material changes via email.
16. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
